During a force majeure event, we will make reasonable efforts to resume normal operations. If the event persists for more than 30 days, either party may terminate the agreement with pro-rata refund where applicable.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND PORTFOLIO PRO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Unless both you and Portfolio Pro agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of representative or class proceeding.
Note for Certain Jurisdictions:
Some jurisdictions (including EU member states) do not allow class action waivers. If you are in such a jurisdiction, this waiver may not apply to you, and you may retain the right to participate in class actions as permitted by local law.
